General terms and conditions for tenants

The tenants are hereinafter referred to as tenants and the agency Mr. Lodge GmbH is hereinafter referred to as Mr. Lodge.

1. brokerage for tenants free of commission

The brokerage service of Mr. Lodge GmbH is free of commission for the tenant in accordance with § 2 para. 1a WohnVermittG.

2. rental offers

The tenant will receive rental offers from Mr. Lodge by telephone or e-mail. If the tenant is already aware of an offered property, Mr. Lodge must be informed immediately and proof of this must be provided on request.

3. prohibition on passing on rental offers to third parties

The tenant may not pass on rental offers received from Mr. Lodge to third parties. The rental offers are only intended for the prospective tenant. In the event of unauthorized disclosure, the tenant may be liable to Mr. Lodge for damages (if Mr. Lodge can no longer successfully rent out the apartment offered to the tenant due to the unauthorized disclosure).

4. Mr. Lodge not a party to the lease agreement

The tenant and the landlord, not Mr. Lodge, are solely responsible for the obligations under the rental agreement. Mr. Lodge is not liable to either party to the rental agreement for claims arising from the rental agreement.

5. duty of the tenant to provide information

5.1 The tenant undertakes to fill in the registration form for his search for accommodation truthfully on www.mrlodge.de.

5.2 If the tenant concludes an oral or written rental contract for a rental property offered to him by Mr. Lodge, he must inform Mr. Lodge immediately, but at the latest within 24 hours, and send a copy of the contract upon request.

5.3 If the tenant extends the tenancy beyond the originally agreed period once or several times, he must inform Mr. Lodge immediately and in advance and send a copy of the contract on request.

6 Applicable law, place of jurisdiction and severability clause

6.1 The law of the Federal Republic of Germany shall apply to the tenant's contract.

6.2 The exclusive place of jurisdiction is Munich, provided that the Tenant is a merchant or a legal entity under public law or a special fund under public law or is domiciled outside Germany.

6.3. Should any of the above provisions be or become invalid in whole or in part, this shall not affect the validity of the remaining part of the provision or the remaining provisions. The tenant and Mr. Lodge undertake to replace the invalid provision with a provision that comes closest to what was originally intended and does not run counter to the rental contract

Data protection

Mr. Lodge GmbH takes the protection of personal data very seriously. We want you to know when we store which data and how we use it. As a company under private law, we are subject to the provisions of the General Data Protection Regulation (GDPR), the German Federal Data Protection Act (BDSG) and the German Telemedia Act (TMG). We have taken technical and organizational measures to ensure that the regulations on data protection are observed both by us and by external service providers.
